1. Acceptance of terms
These Terms & Conditions ("Terms") form a binding agreement between you and Edukacy ("Edukacy", "we", "us"), an e-learning brand operating from Airoli, Navi Mumbai, Maharashtra, India. They govern your access to and use of:
- Our marketing website at edukacy.com
- Our learning web app at app.edukacy.com
- The Edukacy Android application
- Any related content, features, and services we offer (together, the "Services")
By creating an account, downloading the app, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. Eligibility
- You must be at least 13 years old to create an account.
- If you are between 13 and 17, a parent or legal guardian must review and consent to these Terms on your behalf.
- You must provide accurate, current, and complete information when registering, and update it as needed.
- You must not use the Services if you have previously been banned from them.
3. Accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You agree to notify us immediately at info@edukacy.com if you suspect unauthorised access.
- We may suspend or terminate accounts that violate these Terms or that pose risk to other users.
4. Use of services
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial educational use.
You agree not to:
- Resell, sublicense, rent, or otherwise commercially exploit the Services
- Scrape, copy, or systematically download content from the Services
- Reverse engineer, decompile, or attempt to extract source code
- Bypass or attempt to bypass paywalls, rate limits, or feature gates
- Share your account credentials with any third party
5. User content
You may submit content to the Services — for example notes, answers, feedback, support messages, or content shared with our AI features ("User Content"). You retain ownership of your User Content.
By submitting User Content, you grant Edukacy a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, and display the User Content solely as needed to operate, improve, and provide the Services.
You represent that:
- You own or have the necessary rights to submit the content
- The content does not infringe any third-party intellectual property or privacy rights
- The content does not contain unlawful, defamatory, or obscene material
6. Intellectual property
All content provided by Edukacy — including but not limited to lesson text, videos, illustrations, graphics, audio, design elements, code, logos, and the Edukacy name — is owned by Edukacy or its licensors and is protected by Indian and international intellectual property laws.
Nothing in these Terms transfers any of those rights to you. Unauthorised copying, redistribution, modification, public display, or creation of derivative works is prohibited.
7. Subscriptions & payments
Some Edukacy features may require a paid subscription. Where they do:
- Pricing and feature inclusions are shown clearly before purchase.
- Payments are processed via Razorpay on the web and via Google Play Billing on Android. Edukacy does not store your full card or banking details.
- Subscriptions may auto-renew unless you cancel before the renewal date. You can cancel at any time from your account settings or via the Google Play store.
- All prices include applicable taxes unless stated otherwise.
- Refunds: Digital subscription fees are generally non-refundable. We may grant refunds at our sole discretion, or where required by law or platform policy (e.g. Google Play's refund window).
8. Prohibited uses
You agree not to use the Services for any of the following:
- Any unlawful purpose, or to facilitate illegal activity
- Harassing, abusing, threatening, defaming, or impersonating other users
- Posting hateful, discriminatory, or sexually explicit content
- Cheating on assessments, sharing answers, or coordinating to defeat anti-cheat measures
- Uploading viruses, malware, or other malicious code
- Attempting to gain unauthorised access to any account, server, or system
- Interfering with or disrupting the integrity or performance of the Services
Violation may result in immediate termination of your account and, where applicable, referral to law enforcement.
9. AI features
Some parts of the Services use artificial intelligence to generate explanations, summaries, or answers. You acknowledge that:
- AI output is generated automatically and may be inaccurate, incomplete, or out of date.
- AI output is not professional advice — do not rely on it for medical, legal, financial, or safety-critical decisions.
- You should verify important information with authoritative sources or qualified professionals.
- If AI output appears harmful or wrong, please report it to us at info@edukacy.com so we can improve.
10. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Edukacy disclaims all warranties — express, implied or statutory — including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, or fully secure. Educational content is provided for general learning and self-study; it is not a substitute for accredited classroom instruction or professional certification.
11. Limitation of liability
To the maximum extent permitted by applicable law, Edukacy and its officers, directors, employees and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from or relating to your use of the Services.
Our total aggregate liability for any claim arising out of these Terms or your use of the Services is limited to the amount you have paid Edukacy in the twelve (12) months preceding the event giving rise to the claim, or INR 1,000, whichever is greater.
12. Indemnification
You agree to indemnify and hold Edukacy harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your User Content
- Your violation of any law or third-party right
- Your misuse of the Services
13. Termination
- You may terminate your account at any time from your account settings or by emailing info@edukacy.com.
- We may suspend or terminate your access immediately, without notice, if you breach these Terms or if your account presents a security or legal risk.
- Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.
14. Governing law & jurisdiction
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles. The courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.
15. Changes to these terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. For material changes, we will notify you via in-app message or email. Continued use of the Services after a change indicates acceptance of the revised Terms. If you do not agree, you should stop using the Services.
